What is a "Called and Failed" and why does it matter?
When your case is called in open court and you don't appear, it's marked "Called and Failed" (C&F) in the court file. The judge typically then issues an Order for Arrest (OFA) — an active warrant for your arrest. The motion we file — officially titled "Motion and Order to Strike Called & Failed, Recall Order for Arrest and Reset Case on a Trial Calendar" — is the specific AOC form that addresses all three at once: strikes the C&F, recalls the warrant, and gets your case rescheduled.
Do I need to appear in court to get my date reset?
In most cases, no — that's the point. Mr. Barker appears on your behalf. For traffic and misdemeanor matters in District Court, the attorney's appearance is typically sufficient. We'll advise you on whether your presence is required based on the specific facts of your case.
I have a warrant — is it safe to move forward?
Yes. Warrants issued for FTA (failure to appear) in NC District Court are routinely recalled by motion. The process we use — filing before the next court session and appearing to argue the motion — is the standard and accepted way to resolve these. An active OFA does not mean you will be arrested if we act promptly. Do not wait.
How quickly can you file?
For most matters, we can file the same day or next business day. The critical window is getting the motion in front of the judge before your case is called again — or before a bond forfeiture becomes final. Speed matters, which is why we don't delay after you hire us.
What counties do you cover?
